These Payment Plan Terms apply where a parent or legal guardian accepts an offered place in Apex Super League and selects an instalment payment option made available by Apex Football Group.

Apex Super League is a competition operated by Apex Football Group, ABN 34 672 323 867.

These Payment Plan Terms should be read together with the Terms & Conditions and Trial, Cancellation & Refund Terms.

When these terms apply

1. When these Payment Plan Terms apply

These Payment Plan Terms apply only after:

  • Apex Football Group has offered a player a place in Apex Super League;
  • the parent or legal guardian has chosen to accept that offer; and
  • the parent or legal guardian selects an instalment payment option.

They do not create an obligation to pay the Apex Super League Total Program Fee merely because a player participates in a trial or assessment.

2. Trial Registration Fees

Where a player entered through an applicable paid trial-registration offer, any Trial Registration Fee is separate from the Apex Super League Total Program Fee unless Apex Football Group expressly states otherwise.

These Payment Plan Terms do not apply to a Trial Registration Fee unless a particular payment arrangement expressly states that they do.

3. Total Program Fee

The Total Program Fee is the total price payable for the player's place in the applicable Apex Super League program.

The applicable Total Program Fee will be disclosed to the parent or legal guardian before they accept the offered place.

All consumer prices are in Australian dollars and inclusive of GST unless expressly stated otherwise.

The Total Program Fee relates to the player's place in the program as a whole and is not calculated on a training-session, match, weekly or monthly attendance basis.

Choosing and confirming a plan

4. Available payment options

Apex Football Group may offer more than one way to pay the Total Program Fee.

Depending on the applicable offer, payment options may differ in relation to:

  • the amount of the initial deposit;
  • the number of instalments;
  • the amount of each instalment;
  • the timing of instalments; and
  • the amount paid upfront.

The Parent Portal or applicable offer will clearly display the available payment options before the parent or legal guardian makes their selection.

The parent or legal guardian is responsible for reviewing the applicable payment option before accepting it.

5. Selection of a payment option

The parent or legal guardian must select one of the payment options made available for the offered place.

Once the offered place has been accepted and the applicable deposit paid, the selected payment option becomes part of the player's registration agreement.

The payment option determines when the Total Program Fee is paid.

It does not change the amount owed into a session-by-session or pay-as-you-go arrangement.

6. 72-hour acceptance period

Unless Apex Football Group expressly states otherwise in writing, an offered place must be accepted within 72 hours from the time the offer is issued.

Within that period, the parent or legal guardian must:

  1. accept the offered place;
  2. complete the required acceptance information;
  3. select a payment option;
  4. accept the applicable terms and policies; and
  5. successfully pay the applicable deposit.

If these requirements are not completed within the applicable 72-hour period, Apex Football Group may allow the offer to expire and release the place to another player.

7. Deposit

Each payment option may have an applicable deposit.

The required deposit will be clearly shown before the payment option is accepted.

Unless expressly stated otherwise, the deposit:

  • forms part of the Total Program Fee;
  • is credited towards the Total Program Fee;
  • is not an additional amount on top of the Total Program Fee; and
  • forms the first payment under the selected payment arrangement.

The player's place is confirmed once the required acceptance process has been completed and the applicable deposit has been successfully received.

The treatment of a deposit following cancellation or withdrawal is governed by the Trial, Cancellation & Refund Terms.

8. Fixed-program commitment

Once the parent or legal guardian accepts the offered place, selects a payment option and pays the applicable deposit, the player enters into a fixed-program registration.

At that point, the parent or legal guardian becomes responsible for payment of the Total Program Fee disclosed before acceptance.

Selecting an instalment payment option does not mean that the parent or legal guardian is purchasing individual training sessions or matches separately.

How instalments work

9. Instalments are a method of paying the Total Program Fee

An instalment arrangement divides payment of the Total Program Fee over the agreed payment schedule.

It is not:

  • a weekly membership;
  • a monthly membership;
  • a casual membership;
  • a pay-as-you-go arrangement;
  • a pay-per-session arrangement;
  • a pay-per-match arrangement; or
  • an arrangement that can automatically be cancelled simply by ceasing attendance.

The parent or legal guardian's financial commitment relates to the Total Program Fee rather than the number of activities personally attended by the player.

10. Payment schedule

The instalment amounts and applicable due dates will be displayed or otherwise provided before the parent or legal guardian accepts the payment option.

By selecting the payment option, the parent or legal guardian agrees to pay the applicable amounts in accordance with that schedule.

The payment schedule forms part of the player's registration agreement.

Apex Football Group will not materially increase the agreed Total Program Fee after acceptance merely because the parent or legal guardian selected an instalment option.

11. How payments are made

The Total Program Fee is paid by bank transfer or card payment, as set out in the applicable offer or Parent Portal.

The method available for a particular payment option will be shown before the parent or legal guardian accepts that option.

Each payment is made by the parent or legal guardian in accordance with the agreed payment schedule, for the amounts properly due under it.

Where a card payment is used, payment information may be securely managed by a third-party payment processor in accordance with its applicable security and privacy practices.

12. Keeping payment arrangements current

The parent or legal guardian is responsible for making each scheduled payment by its due date, using the method arranged with Apex Football Group.

If the payment details previously provided are no longer valid or available, the parent or legal guardian must arrange an alternative payment method where required.

Changing the payment method does not alter the underlying Total Program Fee or payment schedule.

When a payment does not go through

13. Failed payments

Where a scheduled payment is unsuccessful, Apex Football Group or its payment processor may:

  • ask for the payment to be made again;
  • notify the parent or legal guardian of the failed payment;
  • request that payment details be updated; or
  • request that the outstanding instalment be paid using another available method.

A failed payment does not cancel the player's registration or the underlying payment obligation.

14. Overdue payments

Where an instalment remains unpaid after its due date, the amount remains outstanding.

Apex Football Group may contact the parent or legal guardian to arrange payment.

Where an account remains materially overdue after reasonable notice, Apex Football Group may, to the extent permitted by law:

  • temporarily suspend the player's participation;
  • temporarily restrict access to certain Apex Super League services; and/or
  • require the account holder to contact Apex Football Group to resolve the overdue account.

Temporary suspension does not, by itself, cancel the registration or extinguish amounts otherwise payable.

15. Stopping or changing a payment method

Stopping a payment, or ceasing to use the payment method previously arranged, does not by itself cancel the player's Apex Super League registration or the obligation to pay the Total Program Fee.

If the parent or legal guardian no longer wishes to use that payment method, they must arrange an alternative with Apex Football Group.

This does not limit a person's right to dispute an unauthorised or incorrect payment or exercise any other right available under applicable law.

Withdrawal, refunds and changes

16. Withdrawal from Apex Super League

A player voluntarily withdrawing or ceasing attendance after their place has been confirmed does not, by itself, cancel the payment plan.

Unless an adjustment applies under the Trial, Cancellation & Refund Terms or applicable law, the remaining balance of the Total Program Fee continues to be payable.

This applies whether the remaining Total Program Fee is due through scheduled instalments or another agreed payment arrangement.

17. Remaining instalments after withdrawal

Where a player voluntarily withdraws after entering into a confirmed fixed-program registration, scheduled instalments ordinarily continue in accordance with the selected payment option.

This reflects that the instalments are payments towards the Total Program Fee, rather than charges for individual activities as they occur.

Any request to cancel, reduce or otherwise adjust the remaining balance will be dealt with under the Trial, Cancellation & Refund Terms.

18. Refunds and payment adjustments

Any entitlement to:

  • a refund;
  • partial refund;
  • credit;
  • cancellation;
  • transfer;
  • reduction of the remaining balance; or
  • adjustment to future instalments

is governed by the Trial, Cancellation & Refund Terms and applicable law.

Where Apex Football Group approves or is legally required to provide an adjustment, the remaining payment schedule may be updated accordingly.

19. Injury or exceptional circumstances

Where significant medical or exceptional circumstances arise, the parent or legal guardian may request that Apex Football Group review the remaining payment arrangement.

The existence of an injury, illness or other personal circumstance does not automatically cancel the Total Program Fee.

Any adjustment will be considered under the Trial, Cancellation & Refund Terms having regard to the particular circumstances and applicable law.

20. Payment-plan changes

A parent or legal guardian may contact Apex Football Group if they wish to request a change to their payment arrangement.

Apex Football Group may agree to a reasonable variation where appropriate but is not required to offer a different payment option after the original option has been accepted.

Any agreed variation should be confirmed by Apex Football Group.

A requested change does not take effect merely because it has been submitted.

21. Early payment of remaining balance

A parent or legal guardian may contact Apex Football Group if they wish to pay some or all of the remaining Total Program Fee earlier than scheduled.

Early payment does not increase the Total Program Fee unless a separate lawful charge was clearly disclosed and agreed before the payment arrangement was entered into.

Charges, disputes and records

22. Payment processing charges

Any payment-related charge imposed by Apex Football Group will only apply where it is permitted and has been clearly disclosed before the relevant payment arrangement is accepted.

Apex Football Group will comply with applicable payment-network rules and Australian requirements concerning payment surcharges.

23. Chargebacks and payment disputes

A parent or legal guardian should contact Apex Football Group promptly if they believe a payment has been processed incorrectly.

Initiating a chargeback or payment dispute does not, by itself, cancel the player's registration or any underlying amount that is validly payable.

Nothing in these Payment Plan Terms limits a person's right to dispute an unauthorised, incorrect or otherwise disputed transaction through their bank, card provider, payment processor or any process available under law.

24. Amounts owed after the program begins

Once the fixed-program registration has commenced, amounts already due remain payable unless adjusted under the Trial, Cancellation & Refund Terms or applicable law.

Apex Football Group may continue collecting agreed instalments in accordance with the selected payment schedule while the registration remains in force.

25. Debt recovery

Where an amount remains legitimately outstanding after reasonable attempts have been made to resolve the matter, Apex Football Group may take lawful steps to recover the outstanding amount.

Any debt-recovery action will be conducted subject to applicable Australian law.

Apex Football Group will only seek recovery costs from a parent or legal guardian to the extent that those costs are lawfully recoverable.

26. Receipts and payment records

Apex Football Group or its payment processor may issue electronic receipts, payment confirmations or account records.

Parents and legal guardians should retain relevant payment records.

If a parent or legal guardian believes that a payment record is incorrect, they should notify Apex Football Group as soon as reasonably practicable.

27. Payment processor

Apex Football Group may use a third-party payment processor to process deposits and instalments.

Use of a third-party payment processor may also be subject to that provider's applicable terms and privacy practices.

Personal information relating to payments is handled in accordance with the Privacy Policy.

Your rights and how these terms fit

28. Australian Consumer Law

These Payment Plan Terms operate subject to the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Nothing in these Payment Plan Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy where doing so would be unlawful.

The fact that a payment plan is used does not remove any rights a consumer may have under Australian Consumer Law.

29. Relationship with the Trial, Cancellation & Refund Terms

These Payment Plan Terms explain how payment of the Total Program Fee operates.

The Trial, Cancellation & Refund Terms determine whether a cancellation, refund, credit or adjustment may apply.

If an approved refund or adjustment changes the amount payable, Apex Football Group will make an appropriate corresponding adjustment to the remaining payment schedule.

30. Relationship with the Terms & Conditions

These Payment Plan Terms form part of the Apex Super League registration framework.

The Terms & Conditions govern the player's overall participation in Apex Super League.

Where the parent or legal guardian selects an instalment option, these Payment Plan Terms also form part of the player's registration agreement.

31. Changes to these Payment Plan Terms

Apex Football Group may update these Payment Plan Terms for future registrations.

The version applicable to an existing payment arrangement will ordinarily be the version agreed when that payment arrangement was entered into.

Apex Football Group will not retrospectively increase an existing participant's agreed Total Program Fee merely by publishing updated Payment Plan Terms.

32. Governing law

These Payment Plan Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.
